Terms of Use

These Terms of Use (“Terms”) govern your use of the MakeupGPT mobile application (“App”) operated by MakeupGPT (“we”, “us”, or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree, do not use the App.

2. Acknowledgement

You and MakeupGPT acknowledge that these Terms are concluded between you and MakeupGPT only, and not with Apple Inc. (“Apple”). MakeupGPT, not Apple, is solely responsible for the App and its content. Nothing in these Terms may conflict with the Apple Media Services Terms and Conditions.

3. Description of Service

MakeupGPT is an AI-powered mobile application that allows users to virtually apply makeup looks to their photos. The App uses artificial intelligence to generate modified images based on user-provided selfies or gallery photos.

4. Scope of License

Subject to your compliance with these Terms, MakeupGPT grants you a limited, non-transferable license to use the App on any Apple-branded devices that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license may also allow access via Family Sharing or volume purchasing where applicable.

5. Account Registration

You may sign in using Apple, Google, or email authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

6. Subscriptions and Purchases

• The App offers optional in-app purchases and subscriptions (“MakeupGPT Pro”) that provide access to premium features.
• Subscription payments are processed through Apple’s App Store. All billing is managed by Apple in accordance with their terms.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription at any time through your device’s Settings > Apple ID > Subscriptions.
• No refunds will be provided for the unused portion of any subscription period, except as required by applicable law or Apple’s refund policies.

7. Free Credits and Ads

• The App may offer a limited number of free credits for generating makeup looks.
• Additional credits may be earned by watching advertisements within the App.
• Free credit availability and ad-based credit amounts are subject to change at our discretion.

8. User Content

• You retain ownership of all photos you upload to the App (“User Content”).
• By using the App, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing the App’s services (i.e., generating AI makeup looks).
• We do not store your original photos or generated images on our servers beyond the time needed to process your request.
• You are solely responsible for ensuring you have the right to use any photos you upload. Do not upload photos of others without their consent.

9. AI-Generated Content

• The App uses third-party AI models to generate modified images. Results may vary and are not guaranteed to be accurate or satisfactory.
• AI-generated images are provided “as is” and are intended for personal, non-commercial use.
• We are not responsible for how you use or distribute AI-generated images.

10. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Upload content that is offensive, harmful, or violates the rights of others
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use the App to create deceptive, misleading, or fraudulent content
• Circumvent any security features or usage limits of the App
• Use automated systems or bots to access the App

11. Intellectual Property

The App, including its design, code, branding, and all related intellectual property, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.

12. Watermark

Generated images may include a watermark identifying MakeupGPT as the source. Removal or alteration of this watermark is prohibited unless you have an active premium subscription that removes it.

13. Maintenance and Support

MakeupGPT is solely responsible for providing all maintenance and support services with respect to the App. You and MakeupGPT acknowledge that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

14. Warranty

MakeupGPT is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any was paid). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of MakeupGPT.

15. Product Claims

You and MakeupGPT acknowledge that MakeupGPT, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to:

1. Product liability claims;
2. Any claim that the App fails to conform to any applicable legal or regulatory requirement; and
3. Claims arising under consumer protection, privacy, or similar legislation.

MakeupGPT’s liability to you shall not be limited beyond what is permitted by applicable law.

16. Intellectual Property Infringement Claims

You and MakeupGPT acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, MakeupGPT, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

17. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

18. Third-Party Terms of Agreement

When using the App, you must comply with applicable third-party terms of agreement. For example, if the App integrates with any wireless data services, you must not be in violation of your wireless data service agreement while using those features.

19. Third-Party Beneficiary

You and MakeupGPT acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

20. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

21. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

23. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.

24. Changes to Terms

We may update these Terms from time to time. The updated version will be indicated by the “Last Updated” date at the top. Your continued use of the App after any changes constitutes acceptance of the new Terms.

25. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
